In accordance with the provisions of Articles 6-III and 19 of Law No. 2004-575 of June 21, 2004 on Confidence in the Digital Economy, known as LCEN, users and visitors, hereinafter the "User", of the site www.yoyofoods.fr, hereinafter the "Site", are hereby informed of the following legal notices.

Connection and navigation on the Site by the User implies full and unreserved acceptance of these legal notices.

These are accessible on the Site under the “Legal Notices” section.

ARTICLE 3 - ACCESS TO THE SITE

The Site is accessible anywhere, 7 days a week, 24 hours a day, except in cases of force majeure, scheduled or unscheduled interruptions that may arise due to a need for maintenance.

In the event of modification, interruption or suspension of the Site, the Publisher cannot be held responsible.

ARTICLE 4 - DATA COLLECTION

The Site assures the User that personal information is collected and processed in accordance with privacy in accordance with Law No. 78-17 of January 6, 1978 relating to information technology, files and freedoms.

Under the Data Protection Act of 6 January 1978, the User has the right to access, rectify, delete and oppose their personal data. The User exercises this right:

GENERAL CONDITIONS OF SALE

Article 1: Application of these general conditions of sale:

The general conditions thus presented apply to any purchase made from the Company on its online store via the website www.yoyofoods.fr. Placing an order implies the customer's full and unrestricted acceptance of the various clauses presented in these T&Cs.

The offers presented by the Company are reserved for professional customers and legal entities such as companies and groups under certain conditions. The customer declares before validating his order to have accepted these General Terms and Conditions and consequently, to adhere to them entirely.



Article 2: Ordering method:

Orders are made on the website www.yoyofoods.fr. It is nevertheless possible to make them by telephone under certain conditions.

The customer creates a basket by choosing the number of products they want. Once their selection has been made, the customer validates their basket and their payment method. After accepting the T&Cs, orders are deemed final once validated by payment for the products.

The Company's verification department is entitled to require proof of identity and address from the customer (K-bis extract, intra-community VAT number for legal entities) to validate the order. In the event of refusal by the customer or non-compliance of the documents, the Company may refuse and cancel the order.

An invoice is issued by the Company and then sent by email to the customer. It is also available in the “my account” section on the website www.yoyofoods.fr

In accordance with the terms of Law No. 80 336 of May 1, 1980, relating to retention of title, the products remain the property of the Company until full payment of the invoices.

The customer becomes the owner and responsible for the items upon delivery, the transfer of possession constituting a transfer of risks.



Article 3: Payment methods and prices:

Payment for products can be made by bank card, transfer or direct payment if collected on site.

For France, prices are expressed in Euros (€) and displayed excluding tax (French VAT and all other applicable taxes).

The price indicated on the product sheets is excluding transport costs.
Shipping costs vary depending on the delivery method chosen by the customer and the location. The Company reserves the right to modify its sales prices at any time.



Article 4: Delivery:

Deliveries are made in Metropolitan France, Corsica, Europe and the World under certain conditions. Upon receipt of payment for the order, the Company launches the transport and delivery operations. The delivery of the items ordered is made to the address provided by the customer. The delivery information provided by the customer is binding on the customer. In the event of an error or lack of information resulting in a defect or absence of delivery, the Company cannot be held responsible.



The carrier is responsible for the integrity of the package during delivery. It is up to the customer to check the contents of the package upon receipt and to make reservations if necessary, as follows: on the delivery slip provided by the carrier or by immediately calling the carrier's customer service, in the presence of the delivery person. And, in all cases, by notifying The Company by email within 2 days of receipt of the package at the following address: contact @ yoyofoods.fr or by telephone. The customer also has the option of refusing the package if its integrity has not been preserved.



The Company undertakes to make every effort to deliver the products ordered as quickly as possible. Delivery times vary depending on the product, the delivery method chosen and the country of destination of the goods.



Article 5: Stock and out of stock:



In the event of a product being out of stock, the Company undertakes to keep the customer informed as soon as possible and will offer its customer various alternatives:

- Replacement of the out-of-stock product with an equivalent product under the same price conditions.

- Reimbursement of the unavailable product(s) or the entire order, depending on the customer's choice.

In the event of a temporary stock shortage, the customer will be offered the choice of waiting until the restocking date that will be indicated to him. The customer will have the option of accepting and waiting to receive his entire order, or requesting partial or complete cancellation of his order.



Article 6: Right of withdrawal:



The customer has a period of fourteen days to withdraw, without conditions.

The withdrawal period expires fourteen days after the day on which the customer, or a designated third party, takes physical possession of the products.

To exercise this right of withdrawal, the customer must notify the Company of his decision to withdraw from this contract by means of an unambiguous statement (for example, letter sent by post or email).

Please note that this right does not apply if the integrity of the packaging of food products is compromised, for obvious reasons of hygiene and health safety.



Effects of withdrawal

In the event of withdrawal from this contract, the Company will reimburse all payments received, including delivery costs without undue delay.
The Company will reimburse using the same means of payment as that used for the initial transaction. The Company may defer reimbursement until receipt of the products or proof of their shipment to the following address: Yoyo Foods 3 rue Aminata Traoré 94460 Valenton

The customer bears the direct costs of reshipping the products.



Article 7: Applicable law and dispute resolution:

These general terms and conditions of sale are governed by French law. In the event of a persistent disagreement concerning these terms and conditions and in the absence of an amicable agreement, any dispute will be brought before the competent French courts.



Article 8: Data protection:

You have the right to access, rectify and delete personal data concerning you that is processed under the responsibility of the Company. You can exercise this right by contacting our customer service at the following address: contact @ yoyofoods.fr



In order to meet customer needs and ensure optimal remote service, the Company is required to record certain personal data (name, first name, address). This information is intended exclusively for the Company.

All credit card payments are 100% secure through the Shopify Pay platform, in accordance with French and international interbank security measures. Shopify Pay allows Internet users to make online purchases in complete security and peace of mind.

Your banking data is encrypted (SSL technology). Your banking data (card number, expiration date, etc.) are not communicated to us under any circumstances.

With the deployment of 3D Secure (recognizable by the “Verified By Visa” or “MasterCard SecureCode” logos), your bank will also ask you when paying to authenticate yourself using confidential information to be entered on a web page of your own bank.
